As used in this agreement ("Agreement"), the terms "you," "your," and "Member" refer to individuals who have purchased or leased an eligible INFINITI vehicle and are automatically enrolled in the INFINITI BEYOND Membership ("Membership"). The terms "we," "us,"
"our," and "INFINITI" refer to INFINITI Middle East, a division of Nissan Middle East FZE, registered under the laws of UAE with its office at PO Box 61111, Jebel Ali Free Zone, Dubai, UAE.

By purchasing or leasing an eligible INFINITI vehicle from an authorized retailer, you are automatically enrolled in the Membership and agree to these Terms and Conditions. Please read this Agreement carefully before utilizing your Membership benefits.

1.1  Signature
Events: Members are eligible to attend exclusive signature events on a
first-come, first-served basis. Each member is allowed one guest ("plus
one"). These events are initially available only in select markets (e.g.,
UAE) and have limited capacity.

1.2  Access Passes:
Members may receive access passes (e.g., wellness or leisure services) on a
first-come, first-served basis for themselves and one guest. Access is subject
to availability and offered in collaboration with third-party partners.

1.3  Promo Codes:
Members can request promo codes for services such as wellness or educational
platforms during their membership term.

1.4  Surprise Gifts:
Members may receive surprise gifts as part of their membership benefits.
Delivery is contingent upon accurate contact information provided by members

2.1 The INFINITI BEYOND Membership is currently available only in the following markets: United Arab Emirates (UAE), Kingdom of Saudi Arabia (KSA), Kuwait, Qatar, and Bahrain.

2.2 Certain benefits under this Membership may only be available in specific markets. For example:Signature Events may be limited to select markets such as the UAE.Access Passes may vary depending on local partnerships with third-party providers.

2.3 We reserve the right to expand or limit the geographical availability of the Membership or specific benefits at our sole discretion.

3.1 Membership is automatically granted upon the purchase or lease of an eligible INFINITI vehicle from an authorized  distributor in one of the specified markets listed in Section 2. The Member must be either:- The primary purchaser/owner of the vehicle; or- The primary driver of the vehicle.

3.2 The Membership is strictly non-transferable. It is tied to the individual associated with the purchase / driver or lease agreement for the eligible vehicle and cannot be transferred to another person or vehicle under any circumstances.

3.3 Only retail customers are eligible for this Membership. Customers purchasing vehicles through brokers, fleet arrangements (involving more than 1 vehicle), or any third party vehicle transaction are not entitled to access Membership benefits.

3.4 Benefits under this Membership are applicable only if the new vehicle is purchased  from authorized distributors/dealers. If the vehicle is sold to a second customer, all Membership benefits will immediately cease and will not transfer to subsequent owners.

3.5 Where a retail customer owns multiple vehicles, a member is entitled to one membership. Membership is assigned solely to the primary purchaser or primary driver assigned at the car handover. 

4.1 A dedicated INFINITI BEYOND mobile application ("App") will be launched in the near future to serve as the central platform for accessing Membership benefits, including event registration, access pass requests, promo code redemption, and updates on exclusive offerings. Members will be notified once the App is available for download.

4.2 Use of the App may be subject to additional terms and conditions that will be communicated at the time of download or use.

4.3 All features or benefits of the Membership will require downloading and using the App. Members will be notified in advance when this requirement is introduced.

4.4 While we aim to provide a seamless experience, we do not guarantee uninterrupted access to the App or compatibility with all devices or operating systems.

4.5 Members will be notified of the arrival of the App through official channels such as email , WhatsApp, SMS notifications and on the website.

5.1 The Membership is designed as a three-year offering; however, we reserve the right to modify or terminate the Membership at our sole discretion (see Section 8).

5.2 Membership start date is from the date of handover or as otherwise communicated by INFINITI during the soft launch period.

5.3 If we decide to end the Membership before its scheduled term, members will be notified at least 30 days in advance.

6.1 Proper Conduct: Members are expected to behave respectfully toward other members, event staff, and third-party partners. Any behavior deemed inappropriate or damaging to INFINITI's reputation may result in suspension or termination of membership benefits.

6.2 Event Participation: Members must follow all rules and guidelines for event participation, including cancellation policies where applicable.

6.3 Accurate Information: Members are responsible for providing accurate contact details for receiving benefits (e.g., surprise gifts). We are not liable for delivery issues caused by incorrect information.

7.1 Some benefits under this Membership are provided through third-party partners. These services are subject to the terms and conditions of those partners. We do not control or guarantee the quality, or reliability of third-party services and disclaim all liability arising from their use.

7.2 We reserve the right to change or update third-party partnerships at any time without prior notice.

8.1. Members are allocated a set of benefit at the sole discretion of INFINITI.

8.2. A member will be notified of available benefits including events, access passes, promo codes.. etc. 

8.3. A member needs to claim a benefit to be able to book or utilize the benefit. Claiming a benefit does not constitute allocation until a member receives the relevant confirmation.

8.4. Benefits are subject to availability and will be allocated on a first-come, first-served basis. We reserve the right to amend, expand, and allocate the membership benefits to ensure all members are provided the opportunity to experience them.
 

8.5. Each benefit has its own validity clause noted over the benefit allocation communication.

8.6. A benefit is considered redeemed once claimed by the member and the validity to use it is triggered. A benefit can become obsolete if not used within the set validity timeframe or in case of no show post booking by the member.

8.7. No show of events or use of benefits - where a member claims an event and RSVPs with no show for two consecutive events or benefits, INFINITI has the right to revoke the membership benefits for the remainder of the member’s term.

8.8. Members need to use their registered membership email to avail Benefits at third party partners.

9.1 INFINITI reserves the right to modify or terminate this Agreement or the Membership at any time without prior notice or liability.

9.2 Any changes will become effective once posted on our official website or communicated through other channels specified by us (e.g., email notifications). Your continued participation in the Membership after such changes constitutes your acceptance of the revised Terms and Conditions.

9.3 In cases where the Membership is terminated early, we will make reasonable efforts to notify members at least 30 days prior to termination.

10.1 By agreeing to these T&Cs, you grant INFINITI the right to use your likeness, and any content you voluntarily provide (including testimonials or reviews) for marketing and promotional purposes. This includes but is not limited to:- Advertising campaigns across various media platforms such as social media, websites, print materials and digital advertisements.- Inclusion in newsletters, promotional emails, or other communications related to INFINITI’s services or events.

10.2 You acknowledge that INFINITI will not compensate you for such use unless explicitly agreed upon in writing. 

10.3 By participating in INFINITI’s events or activities as part of the INFINITI BEYOND Program, you consent to being photographed or recorded. You agree that:- INFINITI may use photographs, videos, or other media containing your image or likeness for promotional purposes, including but not limited to:
1. Social media posts

2. Website galleries

3. Marketing materials

4. Event recaps

10.4 All photographs and recordings are the sole property of INFINITI, and you waive any rights to review or approve the final materials.

10.5 For group photographs where individual exclusion is not feasible, your participation in the event will be deemed as consent.

10.6. By accepting these Terms and Conditions, you expressly consent to be contacted by INFINITI BEYOND through various communication channels, including but not limited to phone calls, emails, SMS, WhatsApp messages, or other similar platforms.

11.1 We reserve the right to suspend or revoke membership benefits if:- A member engages in behavior that damages INFINITI's reputation.- A member violates any terms of this Agreement.- Fraudulent or abusive use of benefits is detected.

11.2 Decisions regarding suspension or revocation are made at our sole discretion and are final.

12.1 We collect personal data necessary for managing your membership (e.g., event registration, promo code requests). Your data will be processed in accordance with applicable data protection laws.

12.2 For more details on how we handle your data, please refer to our Privacy Policy available on our website.

13.1 To the maximum extent permitted by applicable law, we disclaim all warranties related to membership benefits provided "as is." This includes but is not limited to implied warranties of merchantability and fitness for a particular purpose.

13.2 Under no circumstances shall we be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your participation in the Membership or use of its benefits.

14.1 All trademarks, logos, text, graphics, and other proprietary materials associated with this Membership are owned by INFINITI Middle East or its licensors.

14.2 Members may not reproduce, distribute, modify, create derivative works from, or use any proprietary materials associated with this Membership without prior written consent from INFINITI Middle East.

15.1 This Agreement shall be governed by and construed in accordance with the laws England without regard to its conflict of law principles.

15.2 Any disputes arising out of or related to this Agreement shall be subject to the exclusive jurisdiction of the   Dubai International Financial Centre (DIFC) Courts in Dubai UAE. 

16.1 This Agreement constitutes the entire understanding between you and us regarding your participation in the Membership and supersedes all prior agreements or representations, whether oral or written.

16.2 If any provision of this Agreement is deemed invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

16.3 We reserve the right to assign this Agreement, in whole or in part, to any third party without prior notice to you. You may not assign or transfer your rights or obligations under this Agreement without our prior written consent.

16.4 Prevailing Language: In case of discrepancies between translations of this Agreement into Arabic language, the English version shall prevail.
